1. Scope and provider
These Terms govern your use of the ScanMe apps for iOS and Android and of the website appscanme.com. The provider is Have a nice day e.U., Schlosspark 54, 2325 Velm, Austria, company register FN 621427p (Landesgericht Korneuburg), email [email protected] (see the Imprint).
If you downloaded the iOS app from the App Store, Apple's Licensed Application End User License Agreement also applies; these Terms supplement it. For the Android app, the Google Play Terms of Service apply to the download and to purchases.
2. The app
ScanMe lets you scan documents with your device's camera, edit them and save or share them as PDF or image files. Scans are processed and stored on your device. Some features — for example unlimited scans and exports — require Premium (see section 5). We keep developing the app and may improve or change it. Changes that would significantly impair Premium features you have paid for are made only for a valid reason and only as far as the law permits.
3. Licence and use
We grant you a non-exclusive, non-transferable right to use the app on devices you own or control, for personal and business purposes. You may not:
- copy, modify, decompile or reverse-engineer the app, except where the law expressly allows it;
- circumvent usage limits, purchase checks or other technical protections;
- use the app for unlawful purposes, or scan and share content you have no right to use.
4. Your documents
Your documents remain yours; we have no access to the files stored in the app. You are responsible for the content you scan and share and for respecting the rights of others (for example copyright and other people's personal data).
Please back up important documents. Documents stored only in the app are lost if you delete the app or lose your device, unless you have backed them up — for example to iCloud or another cloud service.
5. Premium, subscriptions and purchases
- ScanMe is free to download. Premium is available as an auto-renewable subscription (for example weekly or yearly) or as a one-time purchase, depending on your platform and country. Price, period and scope are shown in the app before you buy.
- Purchases are made through the App Store or Google Play and charged to your Apple Account or Google account when you confirm the purchase. The store's terms govern payment, billing, refunds and your statutory right of withdrawal.
- Subscriptions renew automatically for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the end of the current period.
- You can manage or cancel a subscription in your App Store or Google Play account settings at any time. Deleting the app does not cancel a subscription.
- If a free trial is offered, any unused portion of it is forfeited when you purchase a subscription.
- Refunds are handled by Apple (reportaproblem.apple.com) or Google (Google Play). On a new device you can restore your purchases in the app with the same store account.
6. Warranty
Your statutory rights in case of defects remain unaffected. We provide the updates required by law to keep the app working as agreed.
7. Liability
We are liable without limitation for damage caused intentionally or through gross negligence and for personal injury. In cases of slight negligence we are liable only for breach of an essential contractual obligation, limited to the typical, foreseeable damage. These limitations do not apply where mandatory law — in particular consumer protection law or the Product Liability Act — provides otherwise.
8. Third-party services
The App Store, Google Play and cloud services you can connect (iCloud, Google Drive, Dropbox, Microsoft OneDrive, Box, Evernote) are provided by third parties under their own terms. We are not responsible for their availability.
9. Ending the use
You can stop using ScanMe at any time by deleting the app; cancel any subscription separately in your store account. We may end your licence if you seriously breach these Terms.
10. Changes to these Terms
We may update these Terms, for example when features or the law change. The current version is always published here with its date. Significant changes that affect a running subscription will be announced in advance; if you do not agree, you can cancel the subscription before they take effect.
11. Governing law and jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory provisions of the law of the country where you have your habitual residence, and the statutory rules on jurisdiction apply. For businesses, the competent court at our registered office has jurisdiction.
